The effect of reconciliation and mediation On achieving family security In light of Sharia and law

This study examines the most important alternative mechanisms in settling family disputes that aim to achieve family security, which is an essential factor in the life of societies. Islamic Sharia and positive laws have strived to achieve it to the fullest, by taking all necessary mechanisms to do so. Mediation and reconciliation are among the best ways to achieve family security, and therefore sharia texts urged the need to rely on reconciliation to combine the spouses. This was confirmed by the judicial legislation as an obligatory procedure. It is called a judicial reconciliation, and the law also stipulated reform by taking people seeking to reconcile the litigants by finding a compromise that satisfies all parties. This is what the legal legislator excluded from family affairs issues, and he merely provided for the provision of judicial reconciliation and arbitration.
