Abstract

The partnership between the public and private sectors is one of the most important modern mechanisms in solving the problem of financing major projects in light of the shortcomings of the financing agencies and the growing basic needs of government agencies. It is included in various countries, as well as an international definition, then focus on the legal nature of partnership contracts between the two sectors through legal adaptation and then the implications of determining the legal nature of partnership contracts between the public and private sectors.

The study concludes to determine the extent of the contribution of partnership contracts

between the public and private sectors, despite the difficulties and obstacles to their implementation, that it is an effective tool that contributes to reducing state expenditures, as it enhances experiences between the two sectors, allowing the creation of a stable environment that produces a strong economy.
