Abstract

in fact, thereis a close relationship between investment and public deals, as public spending policy has been linked to public orders by encouraging investment, especially foreing ones, to drive growth, this relationship was further confermed through the actuins of economic freedom as a sacred constitutional principal, therfore, the legislator subjected the penalties arsing from investement and deals to international commercial arbitrationn.

This study falls within the general understanding of the emerging relations between the state and the economic operator in the contractual framework, especially if the operator is a foreigner, where the issue of the nature of the investment obligation imposed on the contracting dealing is raised especially when announcing the international request for offers to conclude public deals and implement complex legal problems. We came to the idea that public deals concluded through the procedure for requesting international offers are an investment, at least from the angle of the foreign contractor, and this idea extends within the framework of relations governed by domestic law to international agreements ratified by the Algerian state related to mutual protection of investment, which leads us to research from a legal point of view: public deals as well as investment law.
