New Plant Variety Certificate Within Algerian Law

Abstract

The issue of granting legal protection to the new varieties of plants is one of the emerging intellectual property issues. the increasing importance of approving and setteling this protection is attributed to the rise in scientific research and funds allocated to promote the creation of new varieties of plant in order to meet the needs of the rising demographic growth. with the increasing importance of these plant innovations, thinking in granting legal protection to their owners bacame an urgent necessity. this protection emerged with the conclusion of the first convention on the protection of these varieties witch was Paris convention in 1961. most of the world countries, including Algeria, had adopted for the protection of these varieties, the system of new plant variety certificate. to avoid the difficulties resulting from the application of patent protection system.the new plant variety certificate ensures to its owner legal protection and a serries of rights similar to the protection and rights granted to the patent owner. The negotiations to join the World Trade Organization imposed the Algerian legislature to intervenein order to enact the first law granting protection on such varieties and defined the conditions of granting the certificate of new variety of plant for wich legal effects were arranged.
