Administrative Jurisdiction Oversight over Building Permit In Algeria

Judicial oversigh of administration activities is considered as one of the most important and the most effective forms of control over the work of administration, as it is the primary function of the judiciary in settling conflicts, enforcing the law, and obliging the parties to the dispute to respect the law. In addition, judicial oversight in the field of building permits is regarded as a guarantee for achieving a set of objectives, including ensuring the legitimacy of administrative decisions, hereby, giving the chance to the administrative judge to monitor the decisions issued by the administrative authorities related to the refusal, withdrawal or suspension of works, or the postponement of a building permit that is flawed by the lack of administrative legitimacy; therefore, the administration is required to be aware of the reason that prompted it to issue such decisions, as it is obliged to justify every decision related to building permits in order to eliminate the harm that may be caused to those affected by these decisions subject for cancellation before the Administrative judge.
