Abstract

 The penal system is part of the criminal policy, which is considered one of the policies set by the state to run members of society and advance them to the level it wants, and its means in that criminal law because of its role in reducing the criminal phenomenon by criminalizing a group of acts and determining penalties for them. This system is currently going through a crisis of adaptation to the requirements of society, as it faces the shock of rapid changes that affect the interests and values ​​of society, and this problem is not limited to developing countries only, but also suffers from punitive regimes in economically developed countries, which prompted them to search for solutions to them all in proportion to The legal system on which it is based,Especially with the development of information technology and the increasing reliance on it in daily transactions and the consequent emergence of new criminal behaviors, as well as the development of traditional criminal patterns.

The most important negative effects of this crisis is that it led to the failure of the penal laws to confront or reduce the crime, which is clearly evident through several aspects that highlight this failure. That is why countries have worked to develop their penal systems and adopt methods of discipline and reform that are concerned with the personality of the convict during Punitive execution period.
