Constitutional protection of the principle of original innocence and its relationship to the purposes of Islamic legislation

The research paper deals with the study of two main themes: the first is related to the rooting of the subject in terms of the statement of the truth of principle as a fundamentalist term in Islamic legislation, then the statement of the concept of principle as a legal term with a realistic and procedural effect, and then the statement of its legitimate support in the Qur'an The second axis of the study dealt with the legitimate purposes considered to be the principle in Islamic legislation, and then the relationship of the purposes of Islamic law to the constitutional protection guaranteed by it. The Algerian legislator in its various successive constitutions to the last constitutional amendment of 2020, highlighting models of Arab constitutions such as the Egyptian and Kuwaiti legislators in their compatibility with the Algerian legislator in protecting the principle in accordance with the purposes of Islamic legislation.
