Abstract

This study aims to shed light on hate speech, especially in its religious features and attempts to demonstrate its effects on rights and freedoms, notably the freedom of religion and belief. It delves further into the effectiveness of the Islamic Law approach in dealing with this speech, and the guarantees it provides to protect the freedom of belief against its dangers in responding, on one hand, to the need of the Islamic jurisprudence for such studies, and the need of Islamic and human societies in general to help them get rid of the evil of this speech, which is dominating our lives, on the other hand. The study concludes that the Islamic law has an ethical and legislative asset which constitutes a comprehensive and integrated approach to deal with this speech, much better than secular laws. This approach does not only depend, in dealing with hate speech, on the penal approach, as is often the case with secular laws, but it rather provides a comprehensive approach which prevents its emergence in the first place, and finds plans and strategies that improve its understanding, investment and submission to the world.
