Abstract

This article deals with a study of the fatwa of Sheikh Ahmad Al-Qabsi Al-Maliki and organized by Sheikh Yusef Al-Sherbini Al-Shafei regarding the ruling of one who divorced his wife three times, then wanted to return her without marrying someone else to her, based on the annulment of the first contract by dropping one of its conditions, which is testimony, based on the challenge to the justice of witnesses, as a result of The doctrine of Imam al-Shafi’i, and the statement of the validity of this graduation or not, the ruling of those who issue fatwas and the legitimacy of adopting his fatwa.
