انحراف الاجتهاد في تفسير النصوص وأثره في استنباط الأحكام القضائية الشرعية

Abstract

The interpretation of texts and understanding the connotations of the Shari'a discourse is one of the most important Sciences to help reach the goal of the Almighty, and the nation's scholars have followed over time in taking care of this honorable science, after the companions, may Allah be pleased with them, understood the connotation of the texts sound, the need of Jurists and judges increased, so they formulated its rules to make it easier for them to derive judgments.

Judicial issues have been one of the most pressing issues in need of this knowledge because of the mandatory nature of their rulings, as the judge cannot reach any correct ruling until he has learned the meaning of the texts and interrogated their meanings.

However, the changes of the era and the difficulty of downloading the meanings of texts on the judiciary led some of the latecomers to say abnormal interpretations of texts of a judicial nature, arguing that the rules set by the applicants do not accommodate the requirements of the era, according to their claim; which led to the stripping of texts from their meanings, so that it appears to the recipient that they are defective texts that do not comply with the spirit of the era.
