Abstract

One of the most important characteristics of Islamic law is its perpetuity, comprehensiveness, and suitability for all times and places. Its flexibility has enabled it to confront challenges throughout the ages and contain new developments through the most important means of containment, and through ijtihad and renewal thereof according to the requirements of the circumstances and through its important stages, including the derivation of the basis and its refinement until its realization.

This study, titled: " The conditions and controls of Realization of the Manat", comes to discuss the issue of to what extent the realization of the context is considered a manifestation of renewal, and what are the conditions and controls that govern this type of ijtihad, according to the method of induction. The main problematic issues at the core of the research focused on the realization of the manat, clarifying its meaning as well as the semantic terms surrounding it. It is considered a highly important ijtihad stage to determine the extent to which legal rulings apply to their places. It also aims to clarify the conditions that must be met for the ijtihad method to be fruitful, as well as to determine the controls that regulate this type of ijtihad, in order to ensure the correctness of its application, such as the correct perception of the incident, understanding the purposes of the obligated, and taking into account time and place.
