Considering the rule of the consequence in Maliki fatwa through the book Al-Durar Al-Maknouna in the Nawazil Mazouna By Abu Zakariya Yahya bin Musa al-Maghili al-Mazuni al-Tilimsani (883-1478)

Abstract

This study presents the concept of the rule of considering the consequence and its relations with the jurisprudence of calamities, and explaining the impact of its consideration in the fatwa with a mention of its controls and ranks through practical issues extracted from the book Al-Durar Al-Maknounah By Imam Al-Mazouni, which is one of the sources of the jurisprudence of calamities according to the Malikis .And this is in order to show to what extent we need the rule of considering the consequence  in projecting judgments on reality, reaching a convergence of opinions and minimizing disagreements; to demonstrate the flexibility of  Sharia, the broad horizons of Ijtihad, and to prove the validity of Islam for every time and place.
