The spirit of law: the problematic concept and the dialectic of use

Abstract

     The current study aims to investigate the analysis of the term "spirit of law", and explore its functional dimension in legal knowledge. Owing to achieving the completion of its maturity and establishing its significance, the researcher paved for the jurisprudence of its content. The study was conducted to aspiring the possibility of nominating the term"spirit of law" to generalization so that it can be reduced to all related terminology. The study also aims at structuring its scientific foundations and consolidating its functional methods, so that it could get around the queries of the existing reality, and could promote the desired legal renewal.
