The Effects of Emergency Situations on The Conditions of The Tenancy Contract in The Islamic Jurisprudence and The Algerian Civil Law

Abstract

This research seeks to show the stance of the jurisprudence and the civil law from putting tenancy agreement in exceptional emergency conditions and demonstrating the permissible excuses for the annulment of the contract or alleviating some of its necessities. In it, we compare between Islamic jurisprudence and the Algerian civil law by accentuating the relationship between tenancy contract in emergency situations to the concept of "The Majeure Force" and the concept of "pandemics" in the Islamic jurisprudence.
