Abstract

Prioritizing purposes: words of Ibn al-Qasim and Ashehab as an example The jurist (Al Mujtahid) finds some contradictions when he deals with evidences prioritization following methods such as: prioritizing purposes، which means considering Sharia purposes in strengthening evidences، as: 1- Prioritizing Achahb' words telling that the dead mother's abdomen can be opened to extract a living fetus، for the purpose of self-preservation and offspring protection، over the words of Ibn al-Qasim that inhibit it. 2- Prioritize Ashehab' words obliging the offender to pay blood money to the parents of the murdered deliberately if they accept it، rather than retribution in order to satisfy the victim، instead of the words of Ibn al-Qasim that forbid that.
