Abstract

The subject of the research is treating particularly the jurisprudential maxim and its importance, and distinguished it from the rest of related terminologies Also shows the impact of the rules of jurisprudence in adjusting the contemporary financial transactions, or the so-called-NAWAZIL MALIYAH. the research also concluded that to what extend the jurists utilized the jerus predencial maxims in the efforts of contemporary Ijtihad (Islamic way of understanding the revelation)to help the scholars to formulate a new maxims and to clarify more the inherited ones which make the problems of modern financial transactions are very easy to be solved in the light of Shari’a rules and principles.
