The notion of ‘Right’ in the Islamic jurisprudence can be concluded on three concepts: 1- The Right is a permanent benefit to its owner. 2- The Right is legislated by God. 3- The specific relation between the owner of the Right and its subject. The Right is divided into two main parts: God’s Right and Human Right. The Human Rights in the modern concept means: the total rights and needs which must be -equally- offered to every person, without any separation. We didn’t find a special chapter to Human Rights in jurisprudence books, because they used to detail each Right in its subject. Thus, the modern scholars claimed to specialize a new chapter to human Rights. The Islamic point of view about the world charter for human rights focussed on reminding the precedence of Islamic religion in deciding the Rights, confirming the specify of Islamic culture, and criticizing the duality of the practical standards.
