Apprehension is a comparative study between the Islamic Jurisprudence and the Jordanian rules of sanction

Abstract

This study was made to negotiate the fact of arresting pending on investigations ,which consider on of the serious exceptional procedures that directly affect the freedom of individuals or restrict it , which also breaks the rule that: innocence which consider a constitutional principle. Based on , this study concluded a number of results ,such as: arresting pending on investigation must be within restrictions and guarantees for the arrested person, it also enhances and activates electronic monitoring procedure as a solution for applying the temporary confinement or even reduce it.
