Abstract

With the expansion of the Islamic conquests, many developments emerged on the
jurisprudence arena, and developmentsrelating to the family were among the most prominent
complications faced by the rightly caliphs against right holders of rights, and among these
issues is the issue of infidel women who enter Islam without her husband, and this is
considered one of the most important complications of contemporary marriage in countries.
Non-Muslim, and this subject has known serious complications - especially on the part of
women - as its legal and social dimensions have evolved in a way that requires special
attention, due to the following issues: that Muslims who live in countries other than Islam
adhere to local laws that cooperate provisions with the provisions of the Islamic religion.
Therefore, we need diligence in devising appropriate provisions for them in the light of the
intentions of ijtihad, which is one of the most important things that are directed to
consideration and jurisprudence
