Abstract

This study exposes the position of Ibn Taymia and Ibn Al-Qayim, two Muslim scholars, regarding considering the deeds of the people of Madina as being a principle to consider in extracting Shariah rules. As a matter of fact, Imam Malik founded many of his rules upon this principle which was a subject of disagreement among the majority of Muslim scholars . This study compares and contrasts the positions of two strong contributors in approving Shariah rules: Ibn Taymia and Ibn Al -Qayim by showing how harmonious their positions were in invesigating the strengths and the weaknesses of this principle.
