Cultural Human Rights in Islamic law and Algerian laws

Abstract

Cultural rights are one of the substantive human rights, as the first thing he practiced in his life on earth ; Primarily the right to think ; which has enabled him finding mechanisms of live and preserving life, this sort of rights is addressed in this article, this study was carried on using the comparative method between the Islamic law and Algerian laws, its problematic was therefore drafted that way : how did the legitimacy texts and Algerian legislation texts handle the issue of cultural rights ? Who meditate in the bulk of the legitimacy texts and the situation will find that cultural rights combine many aspects of the material and moral human needs, where the wise legislator made sure that Quran and Sunnah include all provisions related to human rights, cultural rights in particular, the first verse Revelation comes with was an order to exercise a cultural right which consists in reading and seek knowledge, that is what this abidance confirmed. Through its multiple legislation , Algeria has worked on empowering the citizens to enjoy such right, that was manifested itself through the services provided by various public institutions that are known for their cultural, scientific and educational activities ; such universities, schools, vocational training centres and mosques. The Algerian State has also adopted on the different organizations and bodies of a cultural and artistic nature. The Algerian State has also adopted on the different organizations and bodies of a cultural and artistic nature for more promotion and development of the algerian people cultural rights, by seeking to encourage the authors, protect their rights and neighboring rights, establish public reading libraries in all municipalities of the country, work to maintain the tangible and intangible cultural heritage, establish museums and cinemas, to ensure optimal care to this kind of rights, it is recommended that official institutions and voluntary organizations should pay attention to all such things as are conducive to upgrade and develop the culture and make it at the forefront of the civil society and State’s attention. Since cultural right shapes the good citizen features and with it nations and civilizations are built.
