Abstract

The study aimed to attempt to understand the most important provisions contained in the rules of international humanitarian law regarding the prohibition of torture, as it is a grave violation that requires accountability for its perpetrators, and to analyze the provisions of international criminal law concerned with the criminalization of this act by addressing the statutes of the temporary and permanent international criminal courts and as well as the judgments and decisionsissued by it.

From there, the problem of the study revolved around the adequacy of the provisions relating to the crime of torture in international humanitarian law and international criminal law in the light of the growing images.

To answer this problem, the descriptive approachwasused to define the concept of this crime in international humanitarian law and in international criminal law, and the analytical approach to analyze the jurisprudence issued by the international criminal courts and compare its contents.

The study concluded that, in light of the absence of a definition of the crime of torture in international humanitarian law, international criminal courts first resorted to the definition provided by the United Nations Convention Against Torture of 1984 ,then it deviated from this trend by relying on the rules of international humanitarian law and international criminal law based on dropping the official status of the perpetrator and taking into account the nature of the act committed.
