Abstract

Though the right of asylum is an an individual right, however, the refugee should not be considered aloof from his family, because the right to family right is one of the most important human-rights, and given that the refugee are unable to return to his home-country where his family members live, due to persecution and the perils fear ; the principle of the family unity represents an essential basis for the enjoyment of the refugee status, which means that the family members of an officially recognized refugee should also benefit from this status. However, when a refugee is excluded because he has fallen into one of the cases of legal exclusion, in this case the principle of family unity does not apply; while his family members who have been granted refugee status will not be excluded on the basis of this principle.
