Most doctrinal studies undoubtedly illustrate the conceptual instability of hate speech in view of multiple factors directly affecting legislative, judicial or juridical terminology, They are due to legal difference and to the legacies of the historical legacy, Among them are those relating to society's structure and other reasons for developing conflicting concepts, In this paper, we focused on the conceptual approach associated with the jurisprudence of hate speech. And we tried to answer a key question about how to achieve a sound conceptual building for hate speech, By identifying the terminological differences between the narrow and expanding concepts of hate speech and then identify the most important pillars on which the definition of hate speech should be based.
