Abstract

The Algerian legislator introduced a new method for the exploitation of agricultural lands belonging to private national property, known as the agricultural concession, and this is in accordance with Law No. 08/16 that includes the Agricultural Guidance Law, where it was embodied in accordance with Law No. 10/03 that specifies the conditions and modalities for the exploitation of agricultural lands belonging to the private property of the state, and In order to avoid the loopholes that were in the previous regulations, he tried to put mechanisms in place to ensure his protection on the one hand, and to ensure that he does not deviate from the goals set for him, and among the most important mechanisms that were allocated to protect the concession contract within the framework of Law 03/10 are; Administrative protection, mainly represented in the oversight role exercised by the National Office of Agricultural Lands on the exploitation of these properties, in addition to judicial protection through the extension of judicial authorities oversight of every breach in the application of the provisions of Law 03/10, whether by the concessionaire investor, the state, or even third partie ; This issue is of great importance as it is related to one of the sensitive sectors with an economic and social dimension.
