Abstract

The Algerian lawmaker has satisfied himself by the creation of constitutional court without limited her legal nature, nonobstant the objective of estrangement to the political characteristic in their composition and working , However that not sure ,because the practice of designation by the republic president of four members, among them for political reasons, inspite of precautions practiced, for that it IS necessary to replace the designation by method of elections by judiciary power, or High council of the judiciary, for reduction the politicization

That court contains a lot aspect of judiciary character, in the level of membership or function, however that IS not considered judiciary organ, Also it IS look alike more and more, whit European model of constitutional courts, dominated by technical aspects represented a method of specialized control.
