Abstract

 The Bank of Algeria occupies the top of the banking system and enjoys sovereignty and independence, as well as participates, together with the authorities, in the formulation of monetary policy in the country. It is also entrusted with the task of monitoring banks and financial institutions as they engage in banking activities authorized by law to carry out lending operations. Given the serious nature of the bank loan, particularly a mortgage, whether on the lending institution, depositors and the economy as a whole, it was necessary to subject the process to the supervision of the Bank of Algeria, which exercises it through various tools, most notably indirect control tools. Despite all the efforts that have been made, the practical reality proves some shortcomings that need to be addressed in order to ensure effective control.
