The Algerian legislator, through Law No. 18-05 related to electronic commerce, has made it mandatory to document electronic commercial transactions according to an electronic contract ratified by the electronic consumer, which translates the direction of the legislator towards devoting the official electronic that is characterized by electronic documentation, and the e-commerce law included a work plan To move towards new horizons in order to enhance contractual stability and protect the electronic consumer being the weak party in the contractual relationship, which resulted in the necessity of establishing special rules compatible with the privacy of electronic commercial contracts, after the general Sharia rules proved their shortcomings and insufficiency in keeping pace with the technological developments witnessed by the general theory of the contract.
