Abstract

Corruption in the area of public contracts is one of the most dangerous forms of corruption because it is linked directly to financial policy of states ,the fact wic pushed the Algerian legislature as in comparative legislation to criminalize all sorts of prejudice to the principles that rule the conclusion of public contracts such as transparency, fairness and the principle of openness، The aim of this study is to the look for solutions to this dangerous scourge, in order to avoid it or to minimize it at least, and from here arises the problem of corruption spreading extent in the area of public contracts Despite national efforts to combat it.Therefore, the Algerian legislature has endeavored to develop mechanisms to prevent and combat corruption through law No. 06-01 on the prevention and combating corruption as well as through the presidential Decree 15/247 concerning public contracts and mandates of the public service.
the mechanisms to combat corruption must be strengthened and developped supervisorily and legislatively as well as installing effectual internal and external systems of adjusting and control and through activating the role of public contract adjusting authority.
in addition to the coordination of work between committees of public contracts through cooperation and exchange of information And stricter penalties for offenses related to public contracts as they are related to public money and to public interest.
