Abstract

To protect the economic interests, the legislator followed several mechanisms with the aim of enacting texts that would ensure and guarantee such protection, one of these mechanisms is referral to criminalization, or blank criminalization, which is one of the most prevalent methods in the formation of criminal legislation in general and economic ones in particular; the idea of legislative referral resulted from the economic transformations that the world has seen in the recent decades, which were associated with the transformation of the state from its position in the economic field, to manifest from this saying the position occupied by the system of legislative referral in the field of economic criminalization, which makes it an oriented and influential factor in the modern penal policy, considering it as a special framework for criminalization with independent dimensions and distinctive frames
