Abstract

This study aimed to analyze The role of Algerian scholars in making the contemporary Fatwa of Sheikh Muhammad Bay Belalem as a model، and that is by working to show what they presented of rooting the Maliki Fiqh، in line with the developments of their time in the light of the rules، assets and legal purposes، which contributes to the renewal of concepts according to the considered controls which ensures contact with the predecessors.

   For all this، we divided the subject into three chapters، the first is devoted to a question about the use of the term - the production of Fatwa. And the second is devoted to enrich what is said about the life the scientist Sheikh Muhammad Bay Belalem from his birth، his quest for knowledge، his writings and then his death. As for the third، it was about the doctrinal renewal of the Sheikh in El Fiqh and his method of making Fatwas for the Nawazil of this era.
