Abstract

The principle of independence of the arbitration agreement is based on the idea that the fate of this agreement is not related to that of the original contract it contains and therefore the nullity of the initial contract does not affect its validity and its legality, therefore the Arbitration Committee may continue the various proceedings. However, the legal concept of the principle of independence requires first to be identified and then to determine its legal basis and nature, the extent of its recognition by the legal and judicial systems, as well as the implications legal
