Electronic usage has spread widely in such a way it has paved the way to what it called the electronic evidence, which is required by the justice system to treat it as a new proof in the criminal evidence like the traditional proof, therein lies the importance of this subject witch poses problematic about the legality of the digital evidence. This study aims to highlight on this new evidence by discussing it’s conceptual framework in terms of researching it’s concept and characteristics, as well as the procedures of its extraction, along with its legitimacy in the criminal evidence by raising the power of criminal judge to accept and adopt this proof, as well as the rules of his conviction.
