Abstract

  The various Arab and foreign legislations adopted the electronic texts in the evidence and organized them in their internal legislation, as recognized by the Algerian legislator and approved the authoritative written editors, but the proof of these editors is faced with severe practical difficulties, especially in the field of contracts that require special formalities that require the liberalization in line with nature Given their importance and seriousness at the same time. This research aims to show the value of electronic evidence in the proof of negation of the commandment as a serious donation contract, in the presence of official and customary. It also reached the conclusion that the Algerian legislator has tried to keep pace with technological and scientific developments and recognized the authenticity of electronic editors in the proof, but the issue of editing the commandment in electronic form and considered as a strong proof of authentic authenticity is difficult in practice, given the importance and seriousness of this behavior on the one hand and On the other hand, there is no precise legal regulation of electronic editors in our legislation to be in line with this kind of dangerous formal behavior..
