Abstract

This research deals with the role of the Constitutional Court in the field of presidential elections, through the powers assigned to it by the constitutional amendment 2020, as well as Ordinance 21-01 containing the organic law related to the amended and supplemented electoral system, in the preceding and post-conducting presidential elections, and according to Therefore, this research presents a critical legal and analytical view of what is included in Ordinance 21-01, and a number of problems and legal loopholes have been identified, and it has been found that the role that the Constitutional Court is expected to play goes beyond what has been officially stipulated, which requires a review of Order 21-01. On the one hand, and on the other hand, the Constitutional Court is expected to play it within the scope of the internal system that it is specialized in preparing to face these problems
