Criminal mediation and its role in the settlement of family disputes in Algerian legislation

Criminal mediation is a modern and effective mechanisms for resolving criminal disputes, especially when it comes to related persons, as in cases of domestic violence, which led the Algerian legislator to adopt the system of penal mediation under the amended Law 15/02 of the Code of Criminal Procedure Law 15/12 on the protection of the child, where this system is essentially based on the intervention of a third party acting as mediator between the victim and the child. Complainant, provided that the consent of the latter and the success of this system to repair the harm suffered by the victim and to rehabilitate the complainant in a friendly way A For the necessity of a penal follow-up To study this topic, we have relied on a descriptive and analytical approach in order to clarify the most important provisions for criminal mediation in domestic violence crimes. A set of results have been reached, in their entirety, around the importance of this measure in preserving family relations and avoiding overcrowding known to the judicial authorities due to the large number of disputes
