Abstract

At a time when the date of May 8, 1945, for the Allies in particular, and for the Europeans in general, the date of the signing of the armistice and the victory over Nazi Germany in the Second World War that was waged in the name of the right of peoples to self-determination, for Algeria it represents a major turning point after the colonial massacres committed in the north of Constantine, which The maturity of Algerian political thought and the awareness of the national movement showed the need to work to create the appropriate conditions for armed action, which led to the explosion of the glorious liberation revolution and the complete liberation of Algerian lands and the restoration of the stolen national sovereignty.

France committed this series of massacres in many cities, villages and countrysides in the Algerian east, the most horrific of all and the largest of all was in Setif, Kharata and Guelma. It is pursuing an unprecedented policy of military and legal repression to confront what it called the "events of 8 May 1945", without taking into account any international commitment it has undertaken, which are considered in international law as war crimes, crimes against humanity and genocide, which do not have a statute of limitations in accordance with the Nuremberg Charter and the principles it established   Its trials and recognized by the United Nations General Assembly, expose those responsible for its perpetration to legal accountability and the French state to compensate for what its armed forces members committed in accordance with the international texts that were associated with it at the time. Therefore, this paper aimed to reveal the legal aspect of the French policy pursued in suppressing these events and the adaptation of the acts committed within the framework of the rules of international criminal law in force at the time to determine the responsibility of the perpetrators
