Abstract

 In this study we are looking at a new topic related to the defects that directly affect marriage contracts, namely diseases and their effects on the contract, whether infectious or non-communicable diseases, and we want to answer the following question: Do infectious and non-communicable diseases have effects on marriage contracts? Did the contract have to be cancelled or not? To answer them, we used the analytical and inferential approach to research in-depth of the study and concluded that infectious diseases are one of the disadvantages of marriage affecting that can occur because of annulment, but the spouses have the choice only as a result of obvious damage to one of them, non-communicable diseases, in turn, are divided into diseases because of which it is not permissible to ask for separation because they do not affect the course of marital life, and a section because of which it is permissible to ask for separation because of the causes of corruption and interests that are disrupted.
