Legal and Practical Problems with the Crime of Encroachment on State-owned Agricultural Land

Abstract

Art. 386 of the Penal Code gives rise to legal problems affecting the stability of judicial work, in addition to the establishment by the judiciary and the administration procedures that precede the prosecution of the violator, which are not provided for in the article .

This contribution is therefore intended to present the problems of Article 386 and its impact on judicial work and to clarify the specifics of the work of the judiciary and state property directorates on pre-criminal conditions and procedures.

The study came to the fundamental conclusion that the legal and practical problems of the crime of encroachment on state agricultural land would disrupt the legislative purpose and adversely affect the stability of judicial work.
