Abstract

Upon completion of the preparatory procedures for auctioning seized properties and the settling of the litigations that may result from the seizure, the selling of the seized properties takes place at a specified time and place. The sale procedures end by naming the bidder who offers the highest price. However, the highest bid does not mean the winning bid. Rather, it is one of a series of auction procedures through which the judge decides which of the bids is successful and, building on that, decides to end the auction and delivers the successful bid decision, accordingly.

A successful bid decision is made by the judge having the competent authority, and by which the successful bidder will have rights and commitments.

Building on the above, this paper is divided into two main sections. Whereas the first section discusses the legal classification of successful bid judgments, the second section sheds some light on the effects resulting from such a judgment
