Intellectual consideration is a basic characteristic on which Al-Shatibi’s
fundamentalistapproach is based on, a feature that appears in all stages of the approach
he adopted inderiving Sharia rulings from their detailed evidence, whether it is a
matter of classifying andarranging the evidence, or distinguishing between them in
terms of inferential value, or it isrelated to the prioritizing between conflicting
evidence, which made the fundamentalistapproach to him an important tool not only
for the application of Sharia rulings, but also as ameans for reforming the principles
of Islamic jurisprudence, in order to include more broadlyrational consideration, and
for those working in this field to have the ability to derive Shariarulings in the correct
manner, and more than that, to be clever in dropping them on whatcorresponds to
them in terms of incidents in reality, so that this knowledge becomes aspecific tool
for the lawgiver, not a reason for disagreement. An end will not be achievedwithout
diligence, all which is praiseworthy according to Al-Shatibi. If he is right, he has
tworewards, if he errs, he has the reward of diligence, and all of this is for the sake of
reformingthe nation in an era in which conflicts abounded and strife spread.
